DUI Lawyer

DUI Lawyer

It seems like having a DUI lawyer is a common thing nowadays. I don’t know about you, too many celebrities and wannabe celebrities are in the media spotlight because they are out driving when they are obviously intoxicated or worse, high.

DUI LawyerDUI, otherwise known as drive/driving under the influence, is a very serious offence, and so it should be. Imagine, you or even small children out crossing a street and a car comes barrelling down the road at high speed with their senses dulled because of alcohol. Lives are at stake because of irresponsible people who take the wheel when they are obviously incapable of making sound and solid decisions. It must be said that their friends and other adults should never let them drive when they are in this type of condition.

Now, we have made it clear that driving intoxicated is a very serious offence that must not be taken lightly. However, we also have to be fair to people who are charged with DUI, and yet, they are generally responsible people and unaware that they are over the limit (yes, this is possible, despite the huge amount of media coverage of this issue over the past 30 years). But, in a few instances, it may not be fair to lump them with every other DUI offender and give them the same penalty.

What does this mean? Well, if a person has had a drink but is fully in control of his or her faculties, does it mean that they are irresponsible and being a hazard to society when they drive home after a party? Well, yes, it does. But what everyone may not be fully aware of, but is a very common occurrence, is that alcohol remains in the blood for up to 12 hours (yes -12 hours). So if you were out drinking just before going to bed and are pulled over to be breathalysed whilst driving to work the next morning, you could very well be over the limit.

If you exceed the legal amount of alcohol content in your blood and still drive, you are automatically breaking the law and may very well be charged with PCA (prescribed concentration of alcohol) or DUI (driving under the influence), incurring a criminal record for the rest of your life. Ideally, nobody should drink at all when they drive.

This is where the DUI lawyer comes in. A DUI lawyer understands the factors of their client’s arrest and they can protect their rights in the court. Keep in mind that the results of the breathalyser test can be altered by several different factors and can therefore be rendered inaccurate and used unfairly against the person. If this is the case, the DUI lawyer can negotiate to dismiss the case, or at least, can appeal that the person receive the lowest possible sentence.
